
If found guilty of Reckless Imprudence, Richard Gutierrez will spend a maximum of six years in jail. The Metropolitan Trial court of Silang, Cavite has the jurisdiction and the final decision of the case, according to Emmanuel Velasco, the Provincial Chief Prosecutor. The actor was charge for "overspeeding" when his car hit a PLDT post and three coconut trees along the Sta. Rosa-Tagaytay Road on the early morning of May 22, 2009 that resulted to the untimely death of his assistant, Nomar Pardo. Prosecutor Velasco also said that 30 days after his office files the charge, the MTC will issue a warrant of arrest against Richard if it finds enough evidences against him. The actor is required to post a bail of P30,000. "It's up to the court if Richard case will be dismissed, or if there will be a fine for the damages, however, a settlement is still possible at this stage, added the prosecutor. Settlement is possible but it's all up to Richard and Lorayne (Nomar's widow) to settle.

Lorayne should think more of her children and their future. Life is tough and no one know what's in store for them in the future. She probably should choose to settle but settle with very large amount because I'm pretty sure, the children is also Nomar's greatest concern.
She should ask for 10 millions. Mayaman naman ang mga Gutierrez. Kaysa naman makulong si Richard. At saka kikitain naman nila yan.
