Katrina Halili's libel case against Hayden Kho's mother junked

This is the first case that Katrina filed that was junked by the QC Prosecuter's office. People wondered why Katrina filed several irrelevant cases left and right when the issue was about her sex video with Hayden Kho. Many blog commenters left nasty comments against Katrina for accusing Irene of damaging her reputation. They asked "what reputation?"

MANILA – The Quezon City Prosecutor’s Office on Thursday dismissed the libel complaint filed by Katrina Halili against Irene Kho, mother of cosmetic surgeon Hayden Kho, due to lack of probable cause.

In its resolution, the prosecutor’s office said Halili failed to prove that Irene acted with malice when she accused the sexy star of using illegal drugs during her television interviews in May.

Meanwhile, Halili’s legal counsel, lawyer Raymund Palad, said he has yet to see the copy of the resolution.

Palad said he and his client will no longer file any motion for reconsideration before the prosecutor’s office. Halili’s camp will instead go directly to the Department of Justice and file a petition for review, he said.

Halili filed two counts of libel against Irene after the latter accused the actress of using illegal drugs and influencing her son to become a drug user during her television interviews on "TV Patrol World."

Halili and Irene’s son, Hayden, got involved in the sex video scandal, which is now the subject of investigations by different agencies of government. [ABS-CBN}

Hayden Kho and Katrina Halili sex scandal: He said, She said between Belo and Chua

During the Friday press conference presided over by NBI Director Nestor Mantaring, Halili’s lawyer Raymund Palad said Chua admitted that he was instructed by Belo to copy the sex videos of Kho.

“After copying the sex videos, he gave it to Dr. Belo and was instructed to delete the sex videos in the laptop of Kho. So he has no copy at all and the master copy (hard drive) is in the hands of Belo,” said Palad.

This is now going to be a "he said, she said thing", so who really is telling the truth remains to be seen. NBI is now going to hunt the people who uploaded the sex video, so all eyes are watching and waiting.

NBI FOCUSES ON HUNT FOR PEOPLE WHO UPLOADED KHO'S SEX VIDEOS

MANILA, JUNE 8, 2009 (STAR) By Edu Punay - National Bureau of Investigation (NBI) officials disclosed yesterday the probe on the controversial sex video scandal of celebrity surgeon Hayden Kho Jr. and actress Katrina Halili would now focus on a hunt for the people responsible for the posting of the first videos on the Internet.

Head Agent Palmer Mallari, executive officer of the NBI Anti-Fraud and Computer Crimes Division (AFCCD), said investigators are moving to the second phase of the investigation after filing charges of violation of Anti-Violence Against Women and Children Act against Kho before the Department of Justice.

Mallari said the NBI would rely on the technical aspect of the case to unmask those behind the initial uploading of the sex videos on the Internet.

He said those who earlier submitted to the NBI probe are not yet off the hook.

“We studied and evaluated the affidavits and there are denials and conflicting statements so we need to go farther – like (go into) the technical aspects. We are focusing on the initial upload. And then we can apply for search warrant,” said Mallari.

The NBI is not ruling out the possibility of including Dr. Vicki Belo as accessory to the complaint after businessman Eric Johnston Chua claimed in his affidavit that he gave the master copy (hard disc) of the sex videos to Belo.

Chua, in his affidavit, said that he has no copies of the sex video any more because he had already deleted it even before the video of Kho and Halili having sex was circulated on the Internet.

With all the denials and conflicting statements of various personalities who were subpoenaed by NBI, the bureau requested a website host based in the United States to help the bureau open the system log that would identify the person or persons behind the initial uploading of the sex video.

Halili had expressed gratitude to the NBI for the filing of violation of Anti-Violence Against Women and Children Act against Kho due to psychological distress, emotional anguish, public ridicule and humiliation the actress suffered in connection with the release of the sex video.

Halili vowed to fight her case until the person or persons behind the uploading of the sex video on the Internet are identified.

“I expressed gratitude to the NBI, Senator Bong Revilla, Gabriela (women’s support group), and friends and supporters now that a case has been filed against Kho,” said Halili.

The bureau entered the second phase of the investigation aimed at identifying the person or persons behind the upload.

“We already asked our counterparts (website host) to help us for the system log of the websites that could be the key to determine who (is/are) behind the upload,” said Mallari.

Hayden Kho, Katrina Halili sex video proliferation being blamed on Senator Bong Revilla

SEX VIDEO: BLAME REVILLA, NOT HOUSE FOR CYBERSEX PROLIFERATIONMANILA, JUNE 1, 2009 (STAR) By Jess Diaz - A Manila congressman yesterday said Sen. Jamby Madrigal should blame her colleague Sen. Ramon “Bong” Revilla Jr. and not the House of Representatives for the proliferation of the Kho-Halili sex videos.

Rep. Bienvenido Abante Jr., a Protestant bishop, said Revilla sat on the House-approved Bill 3305 when he was chairman of the Senate public information committee.
Abante, the bill’s principal author, said the House approved the bill and transmitted it to the Senate in the early part of 2008.
“I talked to Bong Revilla in July last year to get him to endorse the measure and to convince his colleagues to support it but he did nothing,” he said.
“Had the Senate approved it, it would have been enacted into law and the sex videos of Hayden Kho with Katrina Halili and other women would have been illegal,” he added.
The measure seeks to punish the production, publication, distribution, sale, or exhibition of obscene and pornographic materials, and the exhibition of live sexual acts.
Offenders would have a prison term of six years to 12 years, and a fine of P500,000 to P1 million.
Abante said his proposed law is so strict and tough that the production of sex videos would be prohibited even if these were taken with the consent of the sex partners.
“My bill has been gathering dust in the Senate. Senators are more interested in their right of reply to adverse stories than in fighting obscenity and pornography,” he said.
The Senate’s approved Right of Reply Bill, which Abante’s committee on public information has endorsed, is pending with the House.
Though senators approved it unanimously, some presidential wannabes among them have withdrawn their support for it after media practitioners raised a howl of protest.
Abante said he has talked to his new counterpart, Sen. Alan Peter Cayetano, about the need to get his Bill 3305 moving in the Senate.
Over the weekend, Madrigal criticized the House for not passing the Senate-approved Anti-Child Pornography Bill.
Abante said the bill Madrigal referred to is different from his proposal.
He said his proposed law would prohibit obscene and pornographic productions, whether those involved are children or adults.

Church reacts

This move was welcomed by the Catholic Bishops’ Conference of the Philippines (CBCP), as it urged Congress to pass an anti-cyber crime law to curb the spread of sex videos in the country.
“Whether there is a law coming from the government or not, we know that the sex videos are against morality,” CBCP president and Jaro Archbishop Angel Lagdameo said in an interview with Church-run Radyo Veritas.
The CBCP head said both the government and citizens must work together to stop the ruining of the moral fiber by such pornographic materials now being spread via the Internet.
“We need a vigilant citizen of the state,” Lagdameo said.

Vicky Belo admitted sex video with Hayden Kho

Popular cosmetic surgeon Dr. Vicky Belo on Friday admitted that she also made a sex video with her former beau, Dr. Hayden Kho.

In a press conference Friday night, Belo's lawyer Adel Tamano said her client was forced to make the admission after the sex video of her tryst with Kho started circulating on the Internet. Rumors about the alleged sex video started after Sen. Ramon "Bong" Revilla Jr. revealed that Kho had made 40 sex videos of his trysts with various women including sexy actress Katrina Halili.

Tamano said the sex video was created using a computer with a built-in webcam. He said Belo agreed to shoot the video provided that it would be deleted immediately.

"This was a purely private video between two consenting adults...She didn't say she felt betrayed pero ganun na din," Belo's lawyer said.

Tamano said Belo asked Kho's friend, Eric Chua, to confiscate Kho's hard drive upon learning that Hayden did not delete the sex video. He said Belo also admitted that her company, the Belo Medical Group, owns the hard drive where the videos are stored.

Belo confirmed that there are other sex videos stored in Kho's computer but denied that she had a hand in circulating the same on the Internet. "She did not release these videos and in fact she is very saddened by what has happened. She condemns the release and circulation of these videos," Tamano said.

Tamano said his client will submit an affidavit to the National Bureau of Investigation to explain her side in the controversy. Belo, Kho and Chua have been summoned by the NBI after the sex scandal was first exposed.

Belo said she and Kho remain friends but are no longer together. The popular surgeon earlier had a public falling-out with Kho after learning that he had affairs with other women. [ABS-CBn NEWS]

It has been the talk of the town that Hayden Kho finally admitted to having a relationship with Katrina Halili. This is common to many May-December relationship. Everybody in showbiz are also talking about two-timer Hayden's suicide attempt, and the "I Love You, Vicky!" that he had written in his body when he was rushed to the hospital in which Kayden had confirmed to be true.
